CONSENT AND AGREEMENT FOR ELECTRONIC RECORDS
Please read this information carefully and print a copy and/or retain this information electronically for future reference. You should decide whether doing business electronically and electronic documents (paperless documents) or paper documents are best for you. Doing business electronically and paperless documents can offer significant advantages in terms of speed and convenience.
Introduction. The words “You” and “Your” mean each person who electronically signs and accepts the terms of this Consent for Electronic Records (“Consent Agreement”). The words “we” and “us” and “our” mean Buy Here Pay Here USA, LLC (“BHPH”). We can only give you the benefits of our on-line service if you consent to the use or acceptance of electronic signatures and to the use or acceptance of electronic records or disclosures in this transaction (“Your Consent”). Requests for paper versions. You may request a paper copy from BHPH of any of the Records by writing to BHPH with the details of your request at: email@example.com. Your request for paper copies may be made after Your Consent and after any withdrawal of Your Consent. BHPH will provide the paper copies to you at no charge. BHPH shall retain the Records as required by law.
Consenting to Do Business Electronically. Before giving Your Consent, you should consider whether you have the required hardware and software capabilities described below.
Scope of Your Consent. Your Consent and our agreement to conduct this transaction electronically only apply to this transaction and any transaction we arrange on your behalf. By exercising Your Consent, BHPH (and any party providing credit that we arrange) will conduct this transaction with you electronically.
Hardware and Software Requirements. To access and retain the Records electronically, you will need to use the following computer software and hardware: An IBM™ or MAC™ compatible computer with Internet access and an Internet Browser that supports 128 bit encryption; an account with an email service provider compatible with your email software. To access the latest Internet Browser versions of Safari™, Microsoft Internet Explorer™, Firefox™ and/or Google Chrome™. http://www.apple.com/support/; http://www.microsoft.com/; https://www.mozilla.org/; and https://www.google.com/chrome/. You may incur Internet-related costs in connection with electronic delivery, such as the costs charged to you by your Internet Service Provider and local telephone companies for the time you spend on the Internet or the costs associated with printing email notifications and Records. If at any time during this transaction these requirements change in a way that creates a material risk that you may not be able to receive Records electronically, we will notify you of these changes.
Email notifications and Records may be made available in either HTML (regular Web hypertext) or Portable Document Format PDF format. Records may be viewed electronically via the Web. You may also print Records with a local printer. Records may be saved to your computed storing the hyperlink on your computer or by downloading and saving the Record the way you would any other file from the Internet. You will need sufficient electronic storage capacity on your computer's hard drive or other data storage unit, in order to download and save Records. To print Records, you will need a printer that is capable of printing from your browser, your email or other applicable software application, or your hard drive or other data storage unit, in order to print paper copies of Records.
If you do not see a document that reads “Test” then you do not have PDF Reader installed on your computer. You can download the necessary software free at any time by clicking on the links below. You should follow the instructions for the download and terms and conditions governing the use of the PDF Reader. The download process may take several minutes. When you successfully complete the download, please return to this page either by book-marking it or using the “back” or history button on your browser to complete the enrollment process.
Consent to Collect, Process and Use Computer/Device Information. To protect both you and us, we use services provided by a third-party to help decide whether to accept transactions from personal computers, mobile phones, or other devices. The third-party service checks whether these devices have been identified with fraudulent or abusive transactions in the past, such as reported instances of identity theft, account takeovers, or malware attacks. Maintaining Valid Email Address. You agree to maintain a true, accurate, valid, active, and complete email address. You must promptly notify us of any change in your e-mail address by contacting Customer Service at 423-472-2000 or by notifying us in writing at firstname.lastname@example.org.
Withdrawing Your Consent. You are free to withdraw Your Consent at any time and at no charge to you. If at any time you wish to withdraw Your Consent, you can send us your request by email to: email@example.com. If you decide to withdraw Your Consent, the legal effectiveness, validity and/or enforceability of prior electronic Records will not be affected.
Change to Your Contact Information. You should promptly notify us and keep us informed of any change in your electronic address or mailing address. You may contact BHPH Customer Service by telephone at 423-472-2000 or by e-mail at firstname.lastname@example.org regarding any such changes. You understand that you should contact us to report any problem with your receiving paperless statements. Except to the extent otherwise required by applicable law, you agree that we have no obligation to re-send, re-transmit, or otherwise deliver to you any Record that we electronically have transmitted to the email address, mobile telephone number, or other electronic address you have provided to us and that has been returned “undeliverable” or otherwise rejected for delivery.
Account Security and Notification. You understand that if you disclose your password to other people, they may also have the ability to access your Account. You agree to notify us immediately if you believe any of your Account has been accessed without your permission.
Other important terms and conditions. You agree that we will not be liable for any delays or failures in performance or for any interruptions arising from any cause or circumstance beyond our reasonable control. You will not send any computer viruses or other messages that could damage our systems. You further agree that you may not assign or transfer this Consent Agreement and that any attempt to assign or transfer this Consent Agreement by you shall be null and void. This Consent Agreement shall be construed according to federal law, including the Electronic Signatures in Global and National Commerce Act (the “Act”) and that you and we both intend that the Act apply to the fullest extent possible to validate our ability to conduct business with you by electronic means. We reserve the right to send paper disclosures in lieu of electronic Records.
Amendments and Modifications. We reserve the right, in our sole discretion, to discontinue the use of electronic Records in connection with any service or to terminate or change the terms and conditions on which you and we use and exchange Records as provided in this Consent Agreement (including changing the hardware and software requirements), or otherwise to amend this Consent Agreement. We also reserve the right to require you to re-accept any amended version of this Consent Agreement as a condition for continuing to do business with us electronically.
YOUR ABILITY TO ACCESS RECORDS. BY CHECKING THE BOX BELOW, YOU ACKNOWLEDGE THAT YOU CAN ACCESS THE RECORDS IN THE DESIGNATED FORMATS DESCRIBED ABOVE.
CONSENT. BY SUBMITTING THE APPLICATION, YOU ACKNOWLEDGE THAT YOU HAVE READ THE INFORMATION ABOUT ELECTRONIC SIGNATURES AND DOING BUSINESS ELECTRONICALLY IN THIS CONSENT AND AGREEMENT FOR ELECTRONIC RECORDS. YOU ACKNOWLEDGE AND DEMONSTRATE THAT (I) YOU CAN ACCESS, AND HAVE REGULAR ACCESS TO ALL APPLICABLE HARDWARE AND SOFTWARE REQUIREMENTS; AND (II) YOU CAN VIEW AND RETAIN THE RECORDS, INCLUDING EMAILS, ACCOUNT DOCUMENTS AND WEB SITES DESCRIBED ABOVE IN EITHER HTML OR PDF FORMATS, AS APPLICABLE. YOU CONSENT TO USING ELECTRONIC SIGNATURES, HAVING ALL RECORDS PROVIDED OR MADE AVAILABLE TO YOU IN ELECTRONIC FORM AND TO DOING BUSINESS WITH BHPH ELECTRONICALLY. YOU ACKNOWLEDGE AND CONSENT FOR US TO COLLECT, PROCESS AND USE YOUR COMPUTER OR DEVICE INFORMATION TO HELP DETERMINE WHETHER SUCH COMPUTER OR DEVICE MAY HAVE BEEN USED IN CONNECTION WITH A FRAUDULENT OR ABUSIVE TRANSACTION IN THE PAST, SUCH AS REPORTED INSTANCES OF IDENTITY THEFT, ACCOUNT TAKEOVERS, OR MALWARE ATTACKS. YOU ACKNOWLEDGE THAT YOU MAY REQUEST A PAPER COPY OF THE RECORDS, WHICH BHPH WILL PROVIDE TO YOU AT NO CHARGE. YOU AGREE TO BE BOUND BY THE TERMS OF THIS CONSENT AGREEMENT.
IF, AFTER READING THE INFORMATION ABOUT THE RECORDS, YOU DO NOT WISH TO USE ELECTRONIC SIGNATURES AND/OR CONDUCT THIS TRANSACTION ELECTRONICALLY, DO NOT MOVE FORWARD WITH THE PROCESS. YOU ACKNOWLEDGE THAT YOUR CONSENT TO ELECTRONIC RECORDS IS REQUIRED IN ORDER TO APPLY FOR CREDIT WITH BHPH OVER THE INTERNET. YOU MAY CALL BHPH AND REQUEST TO CONDUCT THIS TRANSACTION IN PERSON AT ONE OF ITS RETAIL LOCATIONS.

- Copies of all supporting documents. For example, payment records, cancelled checks, court documents, police reports or an FTC Identity Theft Report, showing that an account was the result of identity theft, bankruptcy schedules showing that an account was included in or discharged in bankruptcy (if available)
Only include copies and do not send original documentation. If they do not receive sufficient information, they cannot investigate your claims. They cannot return any copies from your mailed request.
